예산 확보도 걸림돌…'반쪽' 시행 가능성
(서울=연합뉴스) 이상현 기자 = 내년에 서울시내 초등학교에 무상급식을 실시하는 내용을 골자로 하는 조례안이 서울시의회에서 통과되면서 무상급식이 어떻게 이뤄질지에 관심을 모으고 있다.
일단 조례안이 의결됨에 따라 무상급식 전면 실시의 토대는 마련됐지만 단계별 시행을 요구하는 서울시의 강력한 반대와 예산 확보 문제 등 걸림돌이 산적해 있어 실제 실시 여부는 여전히 불투명하다.
서울시의회는 지난 1일 오후 8시40분께 본회의장에서 제227회 정례회 제4차 본회의를 열어 '친환경 무상급식 지원에 관한 조례안'을 의결했다.
민주당 소속 시의원 79명 전원과 교육위원 등 86명이 공동 발의한 무상급식 조례안은 무상급식 지원 대상을 유치원과 초ㆍ중ㆍ고등학교, 보육시설로 하고 초등학교는 내년, 중학교는 2012년 우선 시행하는 내용 등을 담고 있다.
또 매년 7월 말까지 학교급식지원계획을 세우고 그에 따른 경비를 다음해 예산에 우선 반영하도록 했다.
급식경비와 지원대상, 지원방법, 규모 등에 관한 사항을 심의하기 위해 친환경무상급식지원심의위원회를 구성하고 급식지원센터를 설치, 운영하는 내용도 포함됐다.
시의회 민주당측은 지난 6.2 지방선거 이후 한나라당 소속 시의원, 서울시, 교육청, 자치구 등과 민관협의체를 구성해 당차원의 공약이었던 전면 무상급식을 추진했지만 합의점 도출에 실패하고 서울시의 내년 예산안에 무상급식 부분이 제대로 반영되지 않자 결국 조례안 처리를 강행했다.

이날 한나라당 의원 20여명이 본회의 시작 예정시간 전부터 단상을 점거하고 농성하면서 조례안 처리 과정에서 민주당측 의원들과 격렬한 몸싸움이 벌어지기도 했다.
시의회 민주당측과 한나라당측은 8대 서울시의회 개원 이후 무상급식 조례를 두고서 각각 `지방선거를 통한 시민의 선택'과 `부자를 위한 급식'이라며 날선 공방을 펼쳐온 바 있다.
민주당측은 "여러차례 협상을 하며 민주당이 수차례 인내해 왔지만 예산안 심사 등 향후 의사일정이 시급해 더 이상은 공전 상태로 처리를 미룰수 없었다"는 입장이다.
우여곡절 끝에 조례안은 통과됐지만 한나라당이 위법적 측면이 있다며 강력히 반발하고 있고, 서울시도 재의 요구는 물론 소송까지 하겠다는 방침이어서 실제 전면 실시 여부는 불투명하다.
또 통과된 조례가 `학년별 실시' `자치구별 실시' 등 그동안 협의회의 논의 과정에서 공식ㆍ비공식적으로 제시된 안들보다 좀 더 나아간 내용을 담고 있다는 점도 전망을 흐리게 한다.
한나라당측은 "조례안이 부칙에 초등학교와 중학교 무상급식 시기를 못박아 놓는 등 교육감에게 있는 급식지원 업무 권한을 시장에게 부여해 위법 소지가 다분하다"는 주장이다.
또 단계별 실시 방침을 고수해온 서울시도 `조례안에 시장의 예산편성권을 침해하는 부분이 있다'며 당장 재의를 요구하겠다는 방침이다.

만약 서울시가 재의를 요구하면 서울시의회는 이를 받아들이거나 재의결해야 하는데, 재의결할 경우 서울시는 서울광장 조례와 마찬가지로 대법원에 재의결 무효확인 소송을 낼 가능성이 크다.
즉 서울광장 조례와 마찬가지로 `무상급식'도 사법부의 판단을 기다려야하는 '장기전'으로 이어질 수 있는 셈이다.
예산심사 과정에서 민주당측과 서울시가 극단적인 갈등과 이에 따른 정치적ㆍ행정적 부담을 피하고자 대승적인 합의를 이뤄낼 수 있다는 관측도 나오지만 서해뱃길 사업 등을 놓고 양측간 갈등의 골이 깊어진 상태여서 가능성은 크지 않다는 분석이 우세하다.
결국 전면 실시를 하려면 시교육청이나 일부 자치구의 예산뿐 아니라 서울시 등의 지원도 절실한데, 예산편성권이 서울시에 있는 만큼 합의 없이는 조례안이 실질적인 효력을 지니기 어려울 것으로 보인다.
지금까지 초등학교 전면 무상급식은 시교육청이 절반, 서울시와 자치구가 함께 나머지를 부담하는 방식을 전제로 추진돼왔다.
내년 초등학교에 무상급식을 전면 실시하려면 2천295억원 가량이 필요한데 현재 예산안에는 시교육청이 1천162억원, 서울시가 급식지원비로 278억원을 책정해 놓은 상태다.
이에 따라 양측이 최종 합의에 실패하면 당장 내년에는 교육청과 일부 자치구 예산을 활용해 초등학교 3개 학년만을 대상으로 '반쪽짜리' 전면 무상급식이 실시될 가능성이 높다.
