삼성SDS가 법원으로부터 20일 영업정지 처분을 받았다. IT서비스업계에서 유례없는 첫 영업정지 사례다. 

삼성SDS는 지난 21일 정보통신공사업 등록기준 미신고에 따라 다음달 9일까지 20일간 영업정지 처분을 받았다고 공시했다. 

회사측이 추산한 영업정지금액은 1천793억5천842만원으로 최근 매출액 대비 7.19% 수준이다. 

삼성SDS의 영업정지 처분은 지난 2008년 5월 서울시에 사업자등록 갱신신고를 하지 않은데 따른 것이다. 당시 삼성SDS는 정보통신공사업 등록 갱신을 하지 않았다는 이유로 서울시로부터 3개월 영업정지 처분을 받았다. 

이에 대해 삼성SDS는 법원에 영업정지 처분은 과도하다는 행정소송을 제기했고, 법원은 3개월 영업정지 판정에 대해 서울시의 재량권 남용이라 판결했다. 

현행 정보통신공사업법은 사업자 등록을 3년마다 시·도지사에 신고토록 하고 있다. 신고 누락 시 1년 이하의 영업정지나 등록취소를 당할 수 있다. 

삼성SDS측은 영업정지로 인해 수주기회 감소가 예상된다고 밝혔다. 업계에서는 금융권과 공공기관의 대형IT사업 입찰이 상반기에 몰려 있어 적잖은 파장을 예상했다. 

IT서비스 업계 관계자는 “지난해 금융권 차세대사업에서 LG CNS, SK C&C 등에 밀리는 모습을 보인 바 있어, 올해 상황반전에 제동이 걸릴 지 모른다는 관측도 나온다”고 전했다.
